StorySpaces Terms of Service

  1. The Basics

    Please read these terms of service (“TOS”) carefully before you start to use the website as they govern your access to and use of any of the services offered by Storyspaces, and any information, images, text, video or any other forms of media downloaded, uploaded or appearing on the services (collectively referred to as “Content”). In these TOS “you/r” means the individual using the Storyspaces services. The services offered by storyspaces.net (“storyspaces.net”, “we” or “our”) include but are not limited to the StorySpaces website, any other features, content, or applications offered from time to time by the storyspaces website.
    By using our services, you indicate that you accept these terms of service and that you agree to abide by them whether you are a “Visitor” (which means that you simply browsed through the Storyspaces website) or an “Account holder” (which means that you are signed up with Storyspaces), therefore the term “User” shall be taken to mean Visitor or Account holder.
    Access to our site is permitted on a temporary basis, and we reserve the right if need arises to withdraw, suspend, amend or indefinitely close access or the service we provide on our website without prior notice to you. We will not be liable if for any reason our website is unavailable at any time or for any period. In addition, we aim to update our site regularly, and may change the content at any time without prior notice to you. By continuing to use our website, after any changes, you agree to be bound by these TOS. Furthermore any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.
    You are responsible for any content that you post on our website and any consequences that occur as a result.

  2. Privacy

    We process information about you in accordance with our privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

  3. Joining StorySpaces

    By using the services, you warrant that: a) the personal information you provide is complete, accurate and current; b) you will maintain, update or modify that information so as to keep it complete, accurate and current; c) you are thirteen (13) years of age or older. If any of the provided information is incomplete, inaccurate or not current and StorySpaces has reasonable grounds to suspect this, StorySpaces has the right to suspend, delete or terminate your account without prior notice.

  4. Password and Security

    Upon signing up, you will be asked to create a password for your account. It is your responsibility to maintain the confidentiality of your password and account as any activity that goes on under your account is your sole responsibility. Please ensure that you log out of your account after each session of use. You agree to notify StorySpaces immediately if you suspect any unauthorized use of your password or account or any other breach of security. StorySpaces cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

  5. Exclusions of Liability and Limitations

    THE MATERIAL DISPLAYED ON OUR WEBSITE IS PROVIDED WITHOUT ANY GUARANTEES, CONDITIONS OR WARRANTIES AS TO ITS ACCURACY. TO THE EXTENT PERMITTED BY LAW, WE, AND THIRD PARTIES CONNECTED TO US HEREBY EXPRESSLY EXCLUDE:

    • ALL CONDITIONS, WARRANTIES AND OTHER TERMS WHICH MIGHT OTHERWISE BE IMPLIED BY STATUTE, COMMON LAW OR THE LAW OF CONDITIONS
    • ANY LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL LOSS OR DAMAGE INCURRED BY ANY USER IN CONNECTION WITH OUR SITE OR IN CONNECTION WITH THE USER, INABILITY TO USE, OR RESULTS OF THE USE OF OUR SIT, ANY WEBSITES LINKED TO IT AND ANY MATERIALS POSTED ON IT, INCLUDING, WITHOUT LIMITATION ANY LIABILITY FOR:
      • LOSS OF INCOME OR REVENUE
      • LOSS OF BUSINESS
      • LOSS OF PROFITS OR CONTRACTS
      • LOSS OF ANTICIPATED SAVINGS
      • LOSS OF DATA
      • LOSS OF GOODWILL
      • WASTED MANAGEMENT OR OFFICE TIME;
      AND FOR ANY OTHER LOSS OR DAMAGE OF ANY KIND, HOWEVER ARISING AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE, PROVIDED THAT THIS CONDITION SHALL NOT PREVENT CLAIMS FOR LOSS OF OR DAMAGE TO YOUR TANGIBLE PROPERTY OR ANY OTHER CLAIMS FOR DIRECT FINANCIAL LOSS THAT ARE NOT EXCLUDED BY ANY OF THE CATEGORIES SET OUT ABOVE.
      THIS DOES NOT AFFECT OUR LIABILITY FOR DEATH OR PERSONAL INJURY ARISING FROM OUR NEGLIGENCE, NOR OUR LIABILITY FOR FRAUDULENT MISREPRESENTATION OR MISINTERPRETATION AS TO A FUNDAMENTAL MATTER, NOR ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

  6. StorySpaces rights

    We are the owner or the licensee of all intellectual property rights on our website, and all material published on it. This material includes, but is not limited to, the design layout, look, appearance and graphics. Reproduction of which is prohibited. These works are protected by trademark, copyright, and other laws and treaties of both Kenya and around the world. All such rights are reserved. Nothing in these terms gives you the right to use the StorySpaces name, logo or brand as your own.

  7. Your Rights

    For the purposes of these “TOS”, you retain the rights to all the information, images, text, audio, video, or any other form of media. All the content whether publicly or privately posted and their consequences are your responsibility not StorySpaces’.
    You grant us a worldwide, irrevocable, non exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant us the right to sub-license these rights to third parties, and the right to bring an action for the infringement of these rights.
    As part of the services offered, StorySpaces grants you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software it provides to you as part of its services as a view to ease of use and enjoyment of the services provided by Storyspaces, in a way that is permitted by these “TOS”.

  8. Unacceptable Behavior

    You must not use our website in any way or post content that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. Furthermore storyspaces reserves the right to investigate and take the appropriate legal action against anyone who in storyspaces ‘sole discretion, violates this provision, including without limitation, removing the offending content from the storyspaces services, terminating the membership of such violators and reporting such behavior to the respectful law enforcement authorities. In storyspaces discretion, unacceptable, illegal or prohibited content includes but is not limited to:

    • Patently offensive behavior that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
    • Defames, abuses, harasses, stalks, threatens or behavior that violates privacy rights, copyrights, trademark rights, contract rights, or any other rights of any individuals.
    • Behavior that exploits people in a sexual or violent manner and content that contains nudity, obscenities, excessive violence or offensive subject matter or contains a link to an adult website;
    • Solicits or is designed to solicit personal information/data from any one under the age of 18;
    • Publishes unsolicited or unauthorized advertising, promotional materials, "junk mail", "chain letters", "pyramid schemes", "spam" or any other form of solicitation;
    • Transmitting or posting any material that contains in any form software viruses or such programs/software as including but is not limited to; Trojan horses, worms, time bombs, cancel-bots, computer code, spyware, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
    • knowingly interfering with, disrupting or creating an undue burden on the StorySpaces services or the networks or services connected to the StorySpaces services;
    • Impersonate, form a fake or deceptive identity of, including but is not limited to, a StorySpaces employee or falsely state or otherwise misrepresent your affiliation with a person or entity, for the purpose of misleading others as to the identity of the sender of the origin of a message or to harvest or otherwise collect information about others;
    • Furthers or promotes any form of criminal or tortuous activity or enterprise which by way of example includes but is not limited to child pornography, fraud, trafficking in obscene material, drug dealing, theft of trade secrets, providing instructional information about illegal activities such as making or buying weaponry or plotting a terrorism act or act of violence;
    • Using the account and/or password of another member at any time or disclosing your password to any third party or permitting any third party access to your account;
    • Using the StorySpaces services in a manner inconsistent with any and all the applicable laws and regulations.

  9. Links from our site

    Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. When accessing a site via our website we advise you check their terms of use and privacy policies to ensure compliance and determine how they may use your information.

  10. Jurisdiction and applicable law

    These terms of service and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Kenya.

  11. Severability

    If any provision or part of these terms of service is deemed by any court or other competent authority to be unlawful and/or unenforceable, the other provisions or parts will continue to be in effect. If any unlawful and/or unenforceable provision or part would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision or part of the TOS will continue in effect.

  12. Entire Agreement

    These Terms of Service and our Privacy Policy are the entire and exclusive agreement between StorySpaces and you regarding the use of the Storyspaces services.
